These terms are an agreement between you and Whutzthat Labs LLC ("we") covering your use of Whutzthat? and its expansion packs. They add to Apple's Licensed Application End User License Agreement (the standard App Store EULA), which also applies. By playing, you agree to both. Please read the Disputes and arbitration section: it requires most disputes to be resolved individually by binding arbitration rather than in court or in a class action.
Your license
We give you a personal, non-transferable license to use Whutzthat? on Apple devices you own or control, as allowed by the App Store's usage rules. The game, its cards, artwork, sounds and music belong to Whutzthat Labs LLC or its licensors. Please don't copy, resell or redistribute them.
Expansion packs and purchases
Expansion packs, and the Everything Pass that bundles them, are digital content you buy in the app through Apple. Once bought, they stay unlocked on your devices and can be restored with Restore Purchases. Where Apple's Family Sharing is on, purchases may be shared with your family group.
Prices are shown in the App Store before you buy. Apple processes payments, and refunds are handled by Apple under its policies.
After Dark
The After Dark deck and adult packs contain innuendo, drinking references and bar-night humor. They're for adults 18 and over only. By unlocking them, you confirm everyone playing is at least 18. If Apple tells the game that the Apple Account on the phone belongs to someone under 18, adult decks stay locked.
Recording other people
Face Off films the reader. Only record people who agree to it, and get their OK before you save or share a clip. You're responsible for the clips you save and share, and for following the laws where you play.
Play nice
Don't use the game to harass anyone, and don't try to break, reverse engineer or tamper with it. Team and player names you type stay on your device, so keep them friendly for the room you're in.
Disclaimers and limits
Whutzthat? is provided "as is". We work hard to make it fun and reliable but can't promise it will be error-free or always available. To the extent the law allows, Whutzthat Labs LLC isn't liable for indirect, incidental or consequential damages from using the game, and our total liability is limited to what you paid for it. Some places don't allow these limits, so they may not apply to you.
Disputes and arbitration
Talk to us first. If you have a problem with the game, email whutzthat-game@whutzthat.com. Most issues can be sorted out quickly. Before starting arbitration, you and we each agree to try to resolve the dispute informally for at least 60 days after written notice. Send notice by email to whutzthat-game@whutzthat.com with your name, how to reach you, and what the dispute is about.
Binding individual arbitration. If we can't resolve it informally, you and Whutzthat Labs LLC agree that any dispute arising out of or relating to these terms or the game will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. The arbitrator can award the same individual relief a court could. Arbitration fees are handled under the AAA's rules, which limit what consumers pay. The hearing can take place by phone or video, or in the county where you live.
No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine claims of more than one person.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may ask a court to stop infringement or misuse of intellectual property.
Opting out. You can opt out of this arbitration agreement by emailing whutzthat-game@whutzthat.com within 30 days of first accepting these terms, with your name and a clear statement that you're opting out. Opting out doesn't affect any other part of these terms.
If the class action waiver is found unenforceable for a claim, that claim will go to court, not arbitration. If you live in a country whose laws don't allow this kind of agreement (for example in the EU or UK), this section applies only as far as those laws allow, and you keep the right to bring claims in your local courts.
Governing law
These terms are governed by the laws of the State of Georgia and the Federal Arbitration Act, without regard to conflict-of-law rules. For anything that isn't arbitrated, you and we agree to the state and federal courts located in Georgia, unless the law where you live gives you the right to sue at home.
Apple
These terms are between you and Whutzthat Labs LLC, not Apple. Apple isn't responsible for the game or its content, has no obligation to provide support or maintenance for it, and isn't responsible for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
Changes and contact
We may update these terms as the game grows, for example when new packs launch. We'll update the effective date, and continuing to play means you accept the changes. The current version is always at https://apps.whutzthat.com/whutzthat/terms/.
